Simple Eviction (First Notice)

Prepare a 3 day, 30 day, or 60 day notice.
Post or serve notice by registered process server.
(S.E.S) Service charge for transferring proof of service to owner or eviction team.
If the tenant had a security deposit, the owner is required to provide within 21 days a security deposit disposition report.

If the tenant complies with this stage of the eviction and surrenders possession to agent or owner, this will conclude the eviction.

Uncontested Unlawful Detainer Eviction

  • CM-010 civil case cover sheet with owner signature.
  • SUM-130 Summons – unlawful detainer – evection.
  • UD-100 complaint – Unlawful Detainer.
  • 5 prejudgment claim of right to possession provided to process server for service on tenants.
  • Proof of service filed with Superior Court.
  • CIV-100 Request for entry of default.
  • UD-110 Receive judgment & EJ-130 Writ of execution plus a filing fee.
  • Prepare a letter of instructions and deliver to the Sheriff Department along with the writ of execution and pay a Lockout fee made payable to the Tuolumne County Sheriff’s Department. Normally the lockout will take place within 5 to 7 days.
  • Owner to coordinate and meet with Sheriffs deputies at the property to supervise the rekeying and securing of the structure along with documenting the condition of the property and any remaining tenants personal belongings that must be stored for a minimum of 15 days and arrangements made with tenants to recover these items.
  • Owner to provide the tenant with a 21 day disposition of security deposit if the tenant originally provided a security deposit.

S.E.S. Can provide the above field and disclosure services based on an hourly rate. Lockouts normally take less than 3 – 4 hours. Locksmith charges are based on number of locks re-keyed.

  • Add 1 to 2 hours S.E.S court time.
  • If a tenant files for bankruptcy, the above timeline and cost may increase.


If a board up is needed. Two-man crew. (Normally two hours) Field supervisor coordinating & monitoring the removal of tenants personal belongings within the 15 day period. (Normally three hours ) Tenants returning to pick up their personal belongings must be supervised at all times.
